NILU AGRAWAL ORAL ORDER 29-07-2015 Heard learned counsel or the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with G.R. No. 660 of 2015 arising out of K. Nagar P.S. Case No. 58 of 2015 for the offence punishable under Sections 363, 366A, 120B/34 of the Indian Penal Code.

The allegation as made out by the informant is that on 11.02.2015 his daughter Gunjan Kumari aged about 17 years went to the western side of his house for natural call. In the meantime, some miscreants drove her in their motorcycle and took her away. After search it was found that the petitioner has run away with the daughter of the informant. The victim herself in her statement under Section 164 Cr.P.C stated that the petitioner along with one

Patna High Court Cr.Misc. No.20233 of 2015 (3) dt.29-07-2015 2/2 other co-accused had forcibly taken her away in the motorcycle. The injury report at para 51 of the case diary also speaks of sexual assault on the person of the victim.

Under such circumstances, I am not inclined to grant privilege of bail to the petitioner. Hence the application is rejected. (Nilu Agrawal, J) Prakash/- U T
