The petitioner is accused in connection with Pauthu P.S. Case No. 12 of 2013, registered under Sections 147, 148, 149, 341, 342, 323, 325, 324, 307, 447, 448 and 379 of the Indian Penal Code.
The accusation is that on 29.03.2013 at about 03 P.M., Petitioner jumped in the house of informant through roof and opened the door from inside, thereafter, rest 13 accused persons entered in the house of the informant and started to cause assault. In that course petitioner took cash of Rs. One Lakh from the box, one box was taken away by Pappu Sharma and Rintu Sharma took out earring asking to compromise the case
Patna High Court Cr.Misc. No.13761 of 2016 (2) dt.22-04-2016 2/2 otherwise, she will be killed. In that course, she sustained fracture injury due to assault at her hand and her daughter Madhuri also sustained one injury on the cheek Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. Further submission is that petitioner and the informant are next door neighbour and due to land dispute scuffle took place, but informant lodged this case with false allegation of committing theft. Further submission is that petitioner having no criminal antecedent is in custody since 15.02.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Pauthu P.S.
