JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner was ex-Chairman of PACS and accusation against him is that he did irregularities in purchase of paddy in the year 2011-12 causing financial damage to the Government to the tune of Rs. 2,21,40,756/-.
The submission on behalf of the petitioner is that the present case has been lodged on account of political rivalry when the petitioner relinquished his office and moreover, in the course of investigation the financial loss to the Government was found only to the tune of near about Rs. 16,00,000/-. It is further contended by him that as a matter of fact, some interpolations are
Patna High Court Cr.Misc. No.20458 of 2015 (4) dt.08-10-2015 2/2 said to have been made in rent receipts and on the basis of the aforesaid rent receipts the purchase and payment was made. It is further contended by him that co-accused Sikandar Singh and 2 others have already been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court and so far as the petitioner is concerned, investigation against himr has already been completed and it is needless to keep the petitioner behind the bar. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kudra P.S. Case No. 189/2014 to the satisfaction of the Chief Judicial Magistrate, Kaimur (Bhabua). (Hemant Kumar Srivastava, J) S.Pandey/- U T
