JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This is an application for grant of anticipatory bail in connection with Bahera P.S. Case No. 33 of 2019, disclosing offences under Sections 363 & 366A of IPC.
Allegation against the petitioner and other accused persons is of kidnapping the minor daughter of the informant. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. Further, by drawing my attention towards Annexure 2, which is statement under Section 164 of Cr.P.C. of the victim girl, it has been submitted that she had gone on her own sweet will with the petitioner and Annexure 3 (Medical Report) shows that she was found in between 17-18 years of age.

Having heard both sides, considering the above
Patna High Court CR. MISC. No.48679 of 2019(2) dt.05-08-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Benipur, District Darbhanga, in connection with Bahera P.S.
