The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,324,504,506,307 and 379 of the IPC. The prosecution case is that the accused persons named in the FIR including the petitioner came variously armed, when coaccused Pano Yadav assaulted the informant with Farsa causing fracture of skull bone. When the wife of the informant Mira Devi came to rescue, then the petitioner and co accused persons assaulted her and she also received injury. Co-accused Jay Krishna Yadav snatched gold chain worth Rupees Fifty Six Thousand from the wife of the informant.

It is submitted by learned counsel for the petitioner that there is no specific accusation of assault against the petitioner

Patna High Court Cr.Misc. No.61917 of 2017(2) dt.22-12-2017 2/2 and in the background of land dispute, the accusation has been levelled. It is further submitted that co-accused Jay Krishna Yadav against whom there is accusation of snatching gold chain and Surendra Yadav have been granted anticipatory bail vide Cr. Misc. No. 33423 of 2017. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the fact that there is no specific accusation of assault against the petitioner coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM II, Madhepura in connection with Srinagar P.S. Case No. 63 of 2016.
