JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 406/34 of Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is ready to return the alleged money of Rs. 31,60,000/- to the informant in installments within a period of one year.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on

Patna High Court CR. MISC. No.48489 of 2022(2) dt.13-12-2022 2/2 bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Dagarwa P. S. Case No. 58 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that the petitioner shall refund Rs. 5,00,000/- (five lacks) through Bank Draft to the informant at the time of furnishing bail-bond and rest amount i.e., 26,60,000/- (twenty-six lacks and sixty thousand) in 10 equal installments of Rs. 2,66,000/- (two lacks and sixty-six thousand) each shall be refunded through Bank Draft to the informant within a period of one year from the date of furnishing bail-bond, failing which, the learned court below would be at liberty to cancel the bail-bond.
