The petitioner seeks bail in Baroon P.S. Case No. 192 of 2018 instituted for the offence under Section(s) 366A of the Indian Penal Code.
Learned counsel for petitioner submits that petitioner is not named in the written report.
The victim girl, on recovery, has given her statement U/s 164Cr.P.C. wherein, she has stated that this petitioner used to call her from wrong number. On the date of occurrence he called her on phone and gave threat and thereafter she went with him to Patna by train. Thereafter, she went to Siwan and lived in his house for 20 days. He also established physical
Patna High Court CR. MISC. No.45706 of 2019(2) dt.30-07-2019 2/2 relationship with her. The informant has stated her age to be 20 years whereas the court has assessed her age to be 19 years. In this manner from the statement of victim it appears that both victim and petitioner were knowing each other from before. The victim has stayed with petitioner for 20 days in his house.
Petitioner is in custody since 25.10.2018 no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Aurangabad, in connection with Baroon P.S. Case No. 192 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
