The petitioner seeks bail in Biharsharif G.R.P. P.S. Case No. 09 of 2013, registered for the offences punishable under Sections 498A and 304B of the Indian Penal Code. The petitioner is husband. The father of the deceased made allegation that the petitioner killed his daughter due to nonfulfillment of demand of dowry. The post-mortem report also suggests that the injuries found on the body of the deceased caused by hard and blunt substance and the dead body of the deceased was found on the railway track.
It is submitted that there is omnibus and general allegation against the petitioner and his father has already been enlarged on bail.
Patna High Court Cr.Misc. No.21510 of 2015 (3) dt.08-09-2015 2/2 It appears that the case of the petitioner is quite on different footing as the petitioner is the husband. There is specific allegation against him that he caused death of his wife by assaulting her.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
However, the trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order, if the trial is not concluded the petitioner may renew his prayer for bail firstly before the court below. (Prabhat Kumar Jha, J.) KKSINHA/- U T
