The petitioner seeks pre-arrest bail in connection with Sahebpur Kamal P.S. Case No. 261 of 2016 registered under Sections 419, 420, 466, 467, 468, 469 and 471 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that co-accused Ram Bachchan Prasad Singh and Sagar Kumar having identical allegation to that of the petitioner have already been granted pre-arrest bail vide order dated 07.07.2017 passed in Cr. Misc. No.26425 of 2017 and order
Patna High Court Cr.Misc. No.61018 of 2017 (2) dt.21-12-2017 dated 21st December, 2017 passed in Cr. Misc. No.62419 of 2017.
On the other hand, learned counsel for the State submitted that he has not knowledge in respect of the order passed in case of Sagar Kumar. However, he does not dispute that co-accused Ram Bachchan Prasad Singh having identical allegation has already granted pre-arrest bail by a co-ordinate Bench of this Court vide order as contained in Annexure-2 to the application.
Considering the submissions made on behalf of the parties, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Begusarai in connection with Sahebpur Kamal P.S. Case No. 261 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
