JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given fatal blow to the deceased, as a result of which deceased died. Learned counsel for the petitioner submits that the petitioner is son of the deceased and, as a matter of fact, a quarrel took place between the parties on account of petty family feud and, therefore, even if the accusation leveled against the petitioner is assumed to be true, then also, no case under section 302 of the Indian Penal Code is made out.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Chandi P.S.Case No. 324 of 2015, pending in the court of
Patna High Court Cr.Misc. No.12410 of 2016 (2) dt.18-03-2016 2/2 Additional Chief Judicial Magistrate, Hilsa, Nalanda stands rejected.
