The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 386, 387, 392, 34 of the Indian Penal Code and section 27 of the Arms Act.
Accusation against the petitioner and two others is that they came with a rifle and resorted to fire, though no injury was caused to any one. The accused person robbed the motor pump and escaped from the scene.
It is submitted by learned counsel for the petitioner that earlier also two cases were lodged with similar accusation by the informant wherein the petitioner is on bail. Admittedly, no injury was caused to any one.
Patna High Court Cr.Misc. No.61421 of 2017(2) dt.19-12-2017 2/2 Considering the nature of accusation coupled with criminal antecedent, this Court is not inclined to grant anticipatory bail to the petitioner.
However, it may be a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned Court below within a period of six weeks in connection with Pipariya P.S. Case No.2/2017, pending before the Judicial Magistrate, 1st Class, Lakhisarai.
