The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

Prosecution case, in short, is that the informant, who was driver of the truck, was coming from Nawada with truck, in the way four unknown persons overtake his truck and entered in the truck and abused him and they were going to the side Verma Fatehpur and the informant jumped from vehicle and informed to his owner through phone.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.2.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court CR. MISC. No.44862 of 2019(2) dt.22-07-2019 2/2 named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Rajauli P.S. case No.87 of 2018.
