The petitioner is accused in connection with Mahnar P.S. Case No. 228 of 2015, registered under Section 414/34 of the Indian Penal Code.
The accusation is that on seeing the Police party, two persons started to flee away, but both were apprehended by the Police, who disclosed their names as Rohit Sah (Petitioner) and Kundan Kumar. On the basis of their confessional statement, some looted motorcycles were also recovered from the house of Mithilesh Kumar Singh, Pankaj Kumar Rai @ Gugu, Papu Kumar Rai, Kundan Kumar and Dipak Kumar Singh. Learned counsel for the petitioner submits that petitioner is resident of district Samastipur and he had gone to
Patna High Court Cr.Misc. No.13689 of 2016 (2) dt.21-04-2016 2/2 Hajipur in his relation and in course of returning, when he was waiting for bus in the meantime, petitioner has been apprehended by the Police mere on suspicion. Further submission is that petitioner having no criminal antecedent is in custody since 27.12.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-VI, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 228 of 2015. Out of two sureties, one surety must be parent/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
