The petitioner seeks bail in connection with Town P. S. Case No. 306 of 2022 registered for the offence punishable under Sections 414, 419, 420, 379, 34 of the Indian Penal Code. It is alleged that petitioner along with another coaccused entered into the bank and tried to flee after committing
Patna High Court CR. MISC. No.49128 of 2022(2) dt.09-12-2022 2/2 fraud with a customer. However, petitioner was caught by guard and staff and from whom possession 16 ATM cards and Rs. 5520/- have been recovered.
Learned counsel for the petitioner submits that petitioner was apprehended on suspicion and no incriminating article has been recovered from the possession of this petitioner and no one has come forward to complain that he has been cheated by the petitioner. Petitioner is in custody since 01.05.2022.
In the facts and circumstances of the case as also the period of custody and nature of allegation, the Court is inclined to grant bail to the petitioner. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Town P.S.
