Petitioner seeks bail in a case registered under section 7 of the Essential Commodities Act.
According to the first information report the informant Pratap Baitha, Assistant District Supply Officer along with S.D.P.O. Sadar Saharsa raided the godown of M/s Captain Anna Bhandar of Md. Rustam and Koushar and recovered 200 bags of rice 50 kg each and over the bag Govt. of India Central Pul Food Grain written and Hariyana Rice (FCI) Jagdamba Rice Mill Khaizrabad Arwa rice Grade-A tags were connected and all the bags were tagged with red dhaga with machine and further 39 bags of Arms Rice without any tag and tagged by hand were also
Patna High Court Cr.Misc. No.21108 of 2015 (2) dt.13-07-2015 2/2 recovered and further the four hundred bags of wheat written F.C.I. white colour plastic 80 bags tagged with hand were also recovered and finding the said illegal kept for black marketing and the same were seized in presence of independent witnesses. It has been submitted on behalf of the petitioner that petitioner is in custody since 25.03.2015 and charge sheet has been submitted in this case. It is further submitted that petitioner has been falsely implicated in the present case. On behalf of the State it is submitted that petitioner is name in the first information report. Considering the aforesaid facts, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M, Saharsa in Spl Case No. 01/2015 arising out of Saharsa P.S. Case No. 210 of 2015 (Sudhir Singh, J) M.Rahman/- U T
