JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are accused in connection with Motipur P.S. Case No. 13 of 2016 registered under Sections 25(1-b)A, 26(i) and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that Raj Kishore, Rajesh and Jitendra were apprehended by the Police, who disclosed the name of their associates Santosh and Vijay, who succeeded to flee away and they also confessed before the Police that they used to sell the theft and looted materials to the petitioners and petitioners used to sell the same in the higher price.

Patna High Court Cr.Misc. No.13583 of 2016 (2) dt.06-04-2016 2/2 Further submission is that petitioner Raju Kumar Ram has no criminal antecedent whereas petitioner Motilal Ram is accused in Sahebganj P.S. Case No. 52 of 2015 for the occurrence of mar-pit with the villagers, in which he is on bail.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., West, Muzaffarpur in connection with Motipur P.S. Case No.13 of 2016.
