JUSTICE SANDEEP KUMAR ORAL ORDER 04-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 29.03.2022 in connection with Gwalpara P.S. Case No. 74 of 2020 registered for the offence punishable under Sections 307, 394 of the Indian Penal Code and 27 of the Arms Act.

The petitioner has been named by the informant in the F.I.R. but subsequently he has filed an application that he did not name the petitioner.

Accordingly, this application for regular bail is allowed.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet

Patna High Court CR. MISC. No.49165 of 2022(3) dt.04-02-2023 2/2 or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class Udakishungaj, Madhepura in connection with Gwalpara P.S. Case No. 74 of 2020. The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
