2. The petitioner seeks bail in connection with Siwan City P.S. Case No. 91 of 2023 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

3. This is the second attempt of prayer of bail on behalf of the petitioner who is the husband of the deceased.

4. Though in the FIR, the allegation is that the deceased has been killed by the petitioner but the police was informed by the parents of the deceased and postmortem was done. During investigation, it has come that the parents of the petitioner and the sister of the petitioner were not present in the house when the deceased committed suicide. The parents of the petitioner stay in Manipur and the Sister of the petitioner

Patna High Court CR. MISC. No.50807 of 2024(2) dt.02-08-2024 2/2 stays 20 to 25 km away from petitioner's house. Independent witnesses who are neighbours have said that the deceased committed suicide. The petitioner is in jail since 18.03.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the petitioner having clean antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Siwan in connection with Siwan City P.S. Case No. 91 of 2023.
