JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 29-04-2015 This application has been placed before this Court in view of the administration order of the Hon'ble the Chief Justice dated 26.02.2015 which gets reflected from the minutes at Flag 'A'.
The petitioner is languishing in custody since 08.09.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 457, 302 of the Indian Penal Code and 3(1) (viii) (x) (xi) (xv) of SC/ST (Prevention of Atrocities) Act. It is alleged that co-accused Pochan Yadav @ Nilesh Yadav, Ramu Yadav and Mithun Yadav entered into the bed room of the informant when on the order of co-accused Ramu Yadav co-accused Pochan Yadav @ Nilesh Yadav caused firearm injury on the temporal region of the son of the informant.
Patna High Court Cr.Misc. No.6745 of 2015 (03) dt.29-04-2015 2/2 Thereafter, the aforesaid accused persons dragged the victim outside the room, consequently son of the informant succumbed to the injury. It is alleged against the petitioner and others that they were outside the house of the informant and were abusing the informant.
Considering the fact that specific overt act has been alleged against Ramu and Pochan @ Nilesh and a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge -cum- Additional Sessions Judge-Ist, Munger in connection with Sessions Trial No. 967 of 2014 arising out of Bariarpur P.S. Case No. 94 of 2014.
