JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-06-2015 Both the above-said petitions arise out of Parsa P.S. Case No. 152 of 2014 registered under Section-364 of the Indian Penal Code and, accordingly, both the above-said petitions are being heard and disposed off by this common order.
Patna High Court Cr.Misc. No.13467 of 2015 (3) dt.30-06-2015 2/2 Heard learned counsels for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report but in course of investigation, one Shweta Pathak, in whose house, the victim had been kept for certain period, was apprehended and disclosed the name of these petitioners as well as others. Subsequently, one co-accused was arrested and made his confessional statement, naming these petitioners and above all, the motorcycle of the victim was recovered from house of the petitioner in Cr. Misc. No. 22347 of 2015 and later on, the aforesaid motorcycle was released in favour of the victim of the present case.
Considering the nature of offence as well as allegation, levelled against the petitioners and also the materials, available in the case diary, I do not feel it proper to release the petitioners on bail and accordingly, their prayer for bail in connection with Parsa P.S. Case No. 152 of 2014 pending in the court of Sri Vivek Rai, Judicial Magistrate-Ist Class, Chapra stands rejected. (Hemant Kumar Srivastava, J) A.K.V.
