The petitioner is accused in connection with Birpur (Bhimnagar) P.S. Case No. 33 of 2016, registered under Section 394 and 412 of the Indian Penal Code and Section 25(1-B)A/26 of the Arms Act.

The accusation is that three persons including the petitioner snatched the bag of the informant containing Rs. 48,700/- on the point of pistol and fled away. Thereafter, the son of the informant gave the message to his relative and subsequently all the said three persons apprehended, who disclosed their names as Manjur Alam, Pankaj Kumar Singh and Arjun Mehta (Petitioner). On search, a country made pistol and a live cartridge was found in possession of Manjur Alam, whereas

Patna High Court Cr.Misc. No.13774 of 2016 (2) dt.26-04-2016 2/2 Rs. 48,700/- was found in possession of accused Pankaj Kumar Singh and a live cartridge was found in possession of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the alleged cash bag is said to be recovered from the possession of co-accused Pankaj Kumar Singh and not from this petitioner. The petitioner has been apprehended merely on suspicion. The petitioner is in custody since 13.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Birpur in connection with Birpur (Bhimnagar) P.S. Case No. 33 of 2016.
