Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. The alleged occurrence appears to have taken place on account of dispute of passage and the first information report reflects that it was co- accused Mahendra Mahaldar who gave fatal blow to the deceased.

So far as the petitioner is concerned, no specific overt-act has been attributed against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate,
