The petitioner is apprehending arrest in a case registered for the offences punishable under sections 354(B),376/511 of the IPC.

The prosecution case is that when the informant went to ease out on 19.8.2017 at 7-8 P.M., the petitioner attempted to ravish her. On alarm being raised several persons came, thereafter the petitioner snatched gold chain and nose pin of the informant.

It is submitted by learned counsel for the petitioner that in the background of some land dispute the accusation has been levelled. It is further submitted that for the occurrence of 19.8.2017 the FIR was registered on 24.8.2017 and the victim has not been medically examined. Statement has been made in

Patna High Court Cr.Misc. No.61951 of 2017(2) dt.22-12-2017 2/2 paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the delayed lodging of the FIR and the victim being not examined medically coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari in connection with Chakiya P.S. Case No.233 of 2017.
