====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Araria P. S. Case No. 987/2019 in a case registered for the offences punishable under Sections 341, 323, 379, 324, 307, 506, 504/34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner gave knife blow to the informant and his brother-in-law. Injury caused to the brother-in-law of informant was found to be grievous in nature.
4. Learned counsel for the petitioner submits that admittedly there is land dispute between the parties for which Title Suit No. 276 of 2002 is already pending before the learned court below. He next submits that due to land dispute a free fight
Patna High Court CR. MISC. No.52712 of 2024(2) dt.30-08-2024 2/2 took place between the parties in which both sides sustained injuries. Petitioner is in custody since 24.05.2024 and chargesheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.
