The petitioner is languishing in custody since 08.03.2014 in a case registered for the offences punishable under sections 394/302/34 of the Indian Penal Code and 27 of the Arms Act.

The accusation is of robbing the train passengers and on protest being made, the brothers of the informant Mithu Kumar and Sanjay Yadav were shot at, who succumbed to the injuries.

It is submitted by learned counsel for the petitioner that neither there is any recovery from the petitioner nor the petitioner has been put on TIP, the name of the petitioner sprang

Patna High Court Cr.Misc. No.22446 of 2015 (2) dt.09-07-2015 2/2 up on the confession of co-accused Niranjan Sah and the petitioner is a disable persons, statements to that effect have been made in paragraph nos. 7 and 10 of the petition. It is further submitted that co-accused have been granted bail vide Criminal Miscellaneous Nos. 8523 of 2015, 51267 of 2014, 6897 of 2015 and 11482 of 2015.

Considering the aforementioned facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with Mokama P.S. Case No.24 of 2014.
