JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 342, 307, 120B/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The first information report was lodged against unknown persons, but in course of investigation, informant and some witnesses expressed their suspicion against the petitioner and others on the ground that prior to the alleged occurrence, threatening had been given to the deceased due to land dispute. Contention on behalf of the petitioner is that the informant claims himself to be eye witness of the alleged occurrence and admittedly, the informant and the petitioner are co-

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Birpur (Supaul) in connection with Pratapganj P.S. Case No.72 of 2015.
