NILU AGRAWAL ORAL ORDER 10-12-2018 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel appearing on behalf of the Buxar Nagar Parishad, District-Buxar.

Petitioner in the writ application prays for payment of retiral dues which accrued to their mother who retired from the post of Safayee Karamchari on 31.07.2009 from the Nagar Parishad, Buxar. Petitioner stated that only Rs. 30,000/- has been paid as lump sum and no other retiral dues including family pension, gratuity, group insurance, provident fund etc. and difference of salary on account of time bound promotion has yet been given.

Patna High Court CWJC No.10257 of 2018(2) dt.10-12-2018 2/2 Considering the nature of prayer, this writ application is disposed of with a liberty to the petitioner to file a representation detailing all the amounts to be paid under different heads before the respondent no. 2, the Executive Officer, Buxar, Nagar Parishad, District-Buxar which will be disposed of by speaking order within a period of three months from the date of filing of such representation. The admissible dues would be paid within one month thereafter. If any amount is not admissible, the same shall be communicated to the petitioner by registered post.
