JUSTICE PRABHAT KUMAR JHA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner, the informant and learned APP.

The petitioner seeks bail in Udwant Nagar P.S.Case No. 374 of 2014 registered under Sections 302, 201/34 IPC. The wife of the deceased alleged that on 21.10.2014, in the evening, the petitioner and one Veerru Singh took away the deceased with them to see the field but the deceased did not return. The family members of the deceased made inquiry from the petitioner and Veeru Singh but they did not give any satisfactory reply. On the next day, the dead body of Nirmal Kumar Singh @ Indu Singh, the husband of the informant, was recovered from a ditch.

Shri N.K. Agrawal, learned Senior Counsel, appearing for the petitioner, submits that Veeru Singh confessed his guilt but did not name the petitioner. In paragraph nos-92 and 93 of the case diary, Sheomuni Musahar and Ashok Singh disclosed that the petitioner was not with the deceased. It appears that the petitioner and Veeru Singh took the

Patna High Court Cr.Misc. No.4295 of 2015 (3) dt.30-04-2015 2/2 deceased, killed him and his dead body was put in mud in a ditch.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail and accordingly, the same is rejected.
