The petitioner seeks bail in connection with Dariyapur P.S. Case No. 256 of 2021 instituted for the offences under Sections 399 and 402 of the Indian Penal Code read with Section 25 (1-B)a 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.06.2021, charge-sheet has been submitted in the case and has antecedent of four cases and allegation is of recovery of one country-made loaded pistol along with four live cartridges from the possession of the petitioner and a country-made loaded pistol with six cartridges and 7.65 MM pistol recovered from co-accused Arun Rai and one mobile from Jai Hind Rai and Vijay Rai.

Patna High Court CR. MISC. No.58297 of 2021(2) dt.07-03-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated, nothing was recovered from his possession and merely because of his antecedent, the police implicated him in the present case.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 03.06.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - XI Saran at Chapra in connection with Dariyapur P.S. Case No. 256 of 2021, subject to condition that one of the bailor shall be the father of the petitioner, namely, Dhuna Nut and further in the event if the petitioner is implicated in a case of similar nature and it comes to the notice of learned court below, the learned Court below shall forthwith cancel his bail bonds.
