The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,307 and 504/34 of the IPC and Section 27 of the Arms Act. The prosecution case as per the fardbeyan of Prince Kumar alias Tuntun recorded by the S.I. Sakendra Kumar of Arwal Police Station is to the effect that on 3.7.2017 at 10.30 A.M. the informant along with other persons reached near Cement Factory when the petitioner and others came and began abusing and assaulting the informant and, in the meantime, petitioner no. 1 fired and threw a brick, due to which the mirror of the informant's shop was damaged, whereas other accused

Patna High Court Cr.Misc. No.61928 of 2017(2) dt.22-12-2017 2/2 persons assaulted the informant.

It is submitted by learned counsel for the petitioners that admittedly no injury was caused to the informant side and there is counter version of the occurrence also being Arwal P.S. Case No. 126 of 2017 and now both sides have retracted from the initial versions and have filed a petition to that effect before the learned court below. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Keeping in view the fact that there is case and counter case and both sides have retracted from the initial versions, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Arwal in connection with Arwal P.S.
