The petitioners apprehend their arrest in Barh P.S. Case No.132 of 2017 registered under Sections 406 and 420 of the Indian Penal Code.

The informant filed complainant case on the basis of which present FIR was registered. The informant alleged that he was in search of house and approached Gharaunda construction Pvt. Ltd. One Shashi Shekhar disclosed that he is the Managing Director of the construction company. After negotiation, the informant deposited Rs.3,40,000/- through RTGS in the account bearing No.914020031748719 of Gharaunda Construction. But later on

The learned counsel for the petitioner submits that Shashi Shekhar and Ravi Shekhar with whom the informant had talked for purchase of flat have already been granted anticipatory bail vide Order passed in Cr. Misc. No.60296 of 2017 and Cr. Misc. No.45973 of 2017 respectively.

Considering the facts aforesaid that similarly situated persons, namely, Shashi Shekhar and Ravi Shekhar who persuade the informant to purchase the flat and gave the account number of the company has already been enlarged on anticipatory bail, both the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh in connection with in Barh P.S. Case No.132 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
