Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon to do so by the office. The petitioner seeks bail in Kanti PS Case No. 381 of 2015, instituted for the offence under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act. Earlier, thrice the prayer for bail of the petitioner was rejected vide orders dated 18.07.2016, 05.07.2017 and 12.03.2021.

It is the submission of the learned senior counsel that this

No.58607 of 2021(2) dt.22-12-2021 2/2 Court should not insist that the petitioner should renew his prayer for bail before the learned trial Court after rejection by this Court, as such exercise is likely to meet the same fate. Based on such apprehension, this Court is not inclined to exercise jurisdiction, till such time the petitioner renews his prayer for bail before the learned Court below raising the new facts or any further development for consideration of petitioner's prayer for grant of bail.

The application is rejected.
