JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-05-2016 Heard the learned counsel for the petitioner and the learned A.P.P representing the State.

The petitioner seeks bail in connection with Dehri (Dalmiya Nagar) P.S. Case No. 285 of 2015 registered for the offences punishable under Sections 420, 467,468,471 and 406 of the Indian Penal Code.

Allegedly, amount of Rs. 3,90,020/- was illegally withdrawn after committing forgery through different IRCTC POS on different dates. During the investigation, the name of the petitioner and other co-accused transpired that they used to take cash from customers for providing e-tickets and e-tickets were being issued after withdrawing the amount from the account of the

At the outset, on behalf of the petitioner, it is submitted that the petitioner without admitting the allegation is ready to pay Rs. 1 lakh to the informant within 6 months from the date of his release in two installments and further stated that the petitioner, by remaining in custody, has been sufficiently penalized.

The learned A.P.P. duly assisted by the learned counsel for the informant have got no objection in releasing the petitioner on bail on that condition.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (Dalmia Nagar) P.S. Case No. 285 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason

Patna High Court Cr.Misc. No.12527 of 2016 (4) dt.09-05-2016 3/3 shall disentitle the petitioner from privilege of bail, with condition that within six months from the date of release , he will pay Rs. 1 lakh to the informant through bank draft in the name of the informant in two equal installments and the informant will receive the same amount and if the informant did not receive the same amount through bank draft, the same will be deposited in the Court. The aforesaid deposit will be without prejudice and if the petitioner fails in depositing the same amount within the said period, the bail granted to the petitioner shall be deemed to be cancelled.
