JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Ben P. S. Case No. 94 of 2017 registered under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that co-accused Rajendra Sharma, Rajendra Prasad and Umakant Sinha have already been granted pre-arrest bail by different benches of this Court vide orders dated 07.12.2017, 30.11.2017 and 07.12.2017 passed in Cr. Misc. Nos. 54692 of 2017, 55726 of 2017 and 57236 of 2017 respectively. It is further submitted that another co-accused Shiv Kumar Prasad

Patna High Court Cr.Misc. No.528 of 2018 (2) dt.11-01-2018 2/2 has already been granted pre-arrest bail by the court below vide order dated 12.09.2017 passed in ABP No. 2237 of 2017. Learned Additional Public Prosecutor for the State does not dispute the aforesaid submissions of the learned counsel for the petitioner.

In view of the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-III, Nalanda a Bihar Sharif in Ben P. S. Case No. 94 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J.) Kanchan/- U T
