JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is languishing in custody since 15.03.2014 in connection with K. Nagar P.S. Case No. 28 of 2011 for the offences instituted under Sections 144 and 302 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 28.01.2011 at about 3.00 P.M., the informant's son went to Balua Futani Hatia. At about 6.00 P.M., he heard noise that one boy has been caught and being beaten on the allegation of stealing of cycle. He went there and found that boy was his son Md. Nasim. He learnt that Suman Mehta, @ Muswa, Pappu Mehta and Bijay Mehta collectively apprehended his son saying him cycle-chor and raised

Patna High Court Cr.Misc. No.22202 of 2015 (2) dt.16-07-2015 2/2 alarm on which many people brutally assaulted him and caused him badly injured. The Sarpanch of Garhia Balua, Bhup Narain Mehta was also present there, who sent his son to Sadar Hospital, Purnea, on the tempo for treatment. In course of treatment at 1.00 A.M. his son died. It is alleged that out of old land dispute, they have committed such occurrence.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.03.2014 and the charge sheet has been submitted in the present case. It is further submitted that omnibus and general allegation has been made against the petitioner. It is further submitted that other co-accused person have been granted bail vide Cr. Misc. No.18563 of 2012. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, in connection with K.
