JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
Petitioner is named in the first information report along with others and there is allegation that petitioner and his associates committed the murder of informant's husband but after due investigation, police found the accusation untrue and submitted final form showing no clue of the occurrence and learned court below accepted the final form but proceeded on the basis of protest petition and subsequently, took cognizance for the offences. Furthermore, I find that earlier the petitioner was granted
Patna High Court Cr.Misc. No.14040 of 2016 (2) dt.05-04-2016 2/2 privilege of anticipatory bail but subsequently, his anticipatory bail was cancelled on the ground that petitioner had suppressed his criminal antecedent of one case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Manjhi, Judicial Magistrate 1st Class, Muzaffarpur in connection with Piar P.S. Case No. 142 of 2004.
