JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner lodged the present case in respect of killing of his full brother by some unknown persons but in course of investigation, the investigation turned towards the petitioner and petitioner confessed his guilt disclosing this fact that he with the help of his brothers in law committed the murder of deceased due to dispute of family partition. The mobile containing sim of brother in law of the informant is said to have been recovered from the place of occurrence but it appears that except the aforesaid materials, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 214 of 2015.
