The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 363 and 366A/34 of the Indian Penal Code. The prosecution case is that co-accused Mithilesh Kumar Yadav used to give tuition to the informant's minor daughter at his residence. On 09.08.2017, Mithilesh Kumar Yadav enticed away the informant's daughter and when the informant enquired from the petitioner, being the father of co-accused Mithilesh Kumar Yadav, and other family members, he was abused and threatened. The informant alleges that the petitioner facilitated the offence committed by his son.

No.61542 of 2017 (2) dt.19-12-2017 2/2 It is submitted by learned counsel for the petitioner that the thrust of accusation is against Mithilesh Kumar Yadav and petitioner is an old person. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the thrust of accusation is against Mithilesh Kumar Yadav.

Considering the fact that thrust of accusation is against Mithilesh Kumar Yadav, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 90 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
