JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Belhar P.S. Case No. 63 of 2019, registered for the offences punishable under Sections 386, 387, 504 and 34 of the Indian Penal Code. Informant is working as Survey and Sight Engineer in Baba Construction Company. It is alleged that on 12.03.2019 at about 10.00 a.m. while he was looking after the construction work he went to Chinguliya village, at that time, two motorcycle borne persons came there and demanded extortion and also snatched his mobile.

It is submitted on behalf of the petitioner that petitioner is not named in the F.I.R and his name surfaced in this case during course of investigation on the basis of motorcycle which was used in the aforesaid crime, petitioner is said to be

Considering the facts aforesaid and nature of allegation against the petitioner and the fact that petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner above-named on bail Belhar P.S. Case No. 63 of 2019. Accordingly, the same is rejected.

However, the trial court is directed to hold the trial on day-to-day basis and conclude the same within six months from the date of receipt of this order.
