1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Ujiyarpur P.S. Case No. 435 of 2022 registered under Sections 341, 323, 406, 409, 420, 504 of the Indian Penal Code and section 138 of the N.I. Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to village politics. Further he submits that from perusal of Annexure-2, it is apparent that petitioner has already deposited the scholarship amount in the respective account of the students. It is also submitted that petitioner has no criminal antecedent.

4. Having considered the facts and circumstances

Patna High Court CR. MISC. No.48943 of 2023(2) dt.23-08-2023 2/2 of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of S.D.J.M., Dalsingsarai, Samastipur in connection with Ujiyarpur P.S. Case No. 435 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
