Heard the learned counsel for the petitioner and the learned APP for the State.

The present petition is by way of second attempt at the behest of the petitioner for grant of regular bail in connection with Jandaha PS case no. 312 of 2018, registered under Sections 396, 397, 120B of the Indian Penal Code and Section 27 of Arms Act, inasmuch as earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 24.02.2022, passed in Cr. Misc. no. 28231 of 2021. 3.

A report was called for from the learned court of Additional District & Sessions Judge-VII, Vaishali at Hajipur and the same was received vide letter dated 21.09.2023, from which, it appears that charges have not been framed against the

Patna High Court CR. MISC. No.54083 of 2023(5) dt.24-11-2023 2/2 petitioner and other accused persons and moreover, the petitioner is stated to be in custody since 18.02.2019. 4.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the period of custody of the petitioner, I deem it fit and appropriate to admit the petitioner to the privilege of bail.

Accordingly, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of learned court of Additional District & Sessions Judge-VIIth, Hajipur at Vaishali in connection with Jandaha PS case no. 312 of 2018. It is further directed that the petitioner shall appear before the learned trial court on each and every date so fixed by the trial and in default of two consecutive appearances, the present privilege of regular bail shall liable to be cancelled.
