The petitioners seek bail in Dev P.S. Case No. 16 of 2015, registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.
The police raided the house of Binda Yadav from where one motorcycle bearing Registration No. JH04/0684 was
Patna High Court Cr.Misc. No.21717 of 2015 (2) dt.18-06-2015 2/2 recovered. Binda Yadav is said to have disclosed the name of the petitioner. Both the petitioners came to fish market on a motorcycle bearing Registration No. JH015/8531 and the same motorcycle was recovered. The petitioners did not produce any papers.
It is submitted that no motorcycle was recovered from the conscious possession of the petitioners.
From perusal of the seizure list it would appear that the motorcycle was recovered by the northern flank of the road and not from the possession of the petitioner. The petitioners have got no criminal antecedent.
Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Dev P.S.
