JUSTICE PARTHA SARTHY ORAL ORDER 24-03-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Imamganj P.S. Case no. 141 of 2020 registered under sections 465, 467, 468 and 420 of the Indian Penal Code and section 66(D) of the IT Act. As per allegation in the F.I.R., it is stated that the petitioner snatched the ATM card of the informant and brought the same in contact with a bluetooth device. On hulla being raised by the informant, the petitioner was caught. It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. is false and concocted and the petitioner was apprehended under some misunderstanding. He is in custody since 3.8.2020 and charge

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody together with charge sheet having been submitted in the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Imamganj P.S. Case no. 141 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st, Sherghati, Gaya.
