The petitioners seek bail in connection with Majhaulia P. S. Case No.352 of 2021, instituted for the offences under Sections 413, 414 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are in custody since 26.06.2021, charge-sheet has been submitted in the case and have antecedent of one case. Allegation is of recovery of stolen motorcycle from the petitioner, who disclosed that they had stolen motorcycle along with Guddu Paswan.

The learned counsel for the petitioners submits that

No.58374 of 2021(2) dt.08-03-2022 2/3 petitioners have been falsely implicated by the police as they were not able to produce any documents relating to the motorcycle and they had disclosed that they had purchased the motorcycle from Guddu Paswan, but the police implicated them in the case by alleging that the petitioners along with Guddu Paswan had committed the theft of the motorcycle. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioners, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P. S. Case No.352 of 2021, subject to condition that one of the bailors of petitioner no.1 shall be his father namely, Vijay Paswan and one of the bailors of petitioner no.2 shall be his father namely, Hargun Paswan and in the event, if the petitioners are implicated in a case of similar nature and the same comes to the notice of learned Court below, the learned
