Petitioner is accused in connection with Sitamarhi P.S. Case No. 916 of 2015 registered under Sections 302, 201 and 34 of the I.P.C.

Submission is that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has come in the statement of witness Kailash Mahto, as detailed in paragraph no.14 of the case diary, who stated that this petitioner used to reside in a rental house with family in the house of Pankaj Jha where in the Veranda human blood was seen, he raised suspicion against the petitioner having hand in the murder. No.13648 of 2016 (2) dt.12-04-2016 2/2 friendship in between the son of the petitioner and deceased Chandan Kumar and petitioner had demanded cash Rs. 60,000/- Except suspicion, there is nothing against the petitioner to show his involvement in the present case. It is also submitted that petitioner is accused in one another case vide Majorganj P.S. Case No. 114 of 2015, but in that case he is on bail and in the present case, he is in custody since 30.11.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi in connection with Sitamarhi P.S. Case No.916 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
