The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-b) A and 26 of the Arms Act.

As per allegation in the FIR, on disclosure made by co-accused Babloo Yadav in Dumraon P.S. Case No. 146/2022, that he had handed over the arms to the present petitioner, police party proceeded towards his house and apprehended him. On search, one country made pistol and two cartridges were recovered from left side waist of the petitioner. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. In any way petitioner does not indulge in any crime. He is languishing

Patna High Court CR. MISC. No.48784 of 2022(2) dt.18-01-2023 2/2 in judicial custody since 24.03.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Buxar P.S.
