JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is languishing in jail since 29.01.2016 in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and is still ready to keep the informant as wife with full dignity and has not performed second marriage, statement to that effect has been made in para 9 of the petition which reads as follows:- "That the petitioner is always ready to keep his wife with full dignity and honour but she does not want to live with the petitioner. The petitioner not remarried with any girl."

No.12744 of 2016 (2) dt.17-03-2016 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No. 717 of 2015.
