JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Shastri Nagar P.S. Case no. 284 of 2017, registered under Section 376 of the Indian Penal Code.

The accusation is that informant used to do the work of salesman in the shop of Shailesh Kumar since eight years. In that course, Shailesh Kumar developed physical relation with the informant on the allurement of marriage, when she made protest then informant was assaulted by Shailesh Kumar and his family members. Thereafter, informant came to know that Shailesh Kumar is living with this petitioner, who is cousin of the Shailesh Kumar. Learned counsel for the petitioner submits that it would appear from the F.I.R. that allegation of developing physical relation

Patna High Court Cr.Misc. No.60889 of 2017 (2) dt.14-12-2017 2/2 with the informant is against Shailesh Kumar. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class Patna in connection with Shastri Nagar P.S. Case No.284 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
