The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.
Wife of the petitioner died after five years of marriage. Allegation is that death was caused by bitterly assaulting her due to non-fulfillment of the dowry demand. Submission is that doctor has not found any external injury on the person of the deceased and it might be for some trivial dispute in the family she might have committed suicide for any other reason. The petitioner is in custody since 14.05.2019.
Finding substance in the submission aforesaid as well
Patna High Court CR. MISC. No.44926 of 2019(3) dt.30-09-2019 2/2 as completion of investigation of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gamharia P.S. Case No.29 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
