JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-435, 379 & other minor sections of the Indian Penal Code.

All the petitioners are named in the first information report with accusation that they along with more than 100 persons, assaulted the brother of owner of the truck, which had caused accident, in which, one person died but having more or less similar allegation, some co-accused have already been granted privilege of anticipatory bail by a coordinate bench of this court and some other accused have been released on regular bail. Accordingly, petitioners named above, are directed to

No.12857 of 2016 (2) dt.31-03-2016 2/2 be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kahalgaon (Ghogha) P.S. Case No. 70 of 2015 to the satisfaction of Sri A. Shamim, learned Judicial Magistrate, Bhagalpur.
